Terms of Service
These Terms of Service govern your access to and use of TrackSES, published by 12N Labs. By creating an account or using the service, you agree to these Terms.

1. Acceptance and definitions
By accessing or using TrackSES, you confirm that you are at least 18 years old and that you accept these Terms. If you use TrackSES on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. You also confirm that you have read and accepted our Privacy Policy, available at /privacy. In these Terms, "we", "us", and "our" refer to 12N Labs; "you" refers to the customer; and "service" refers to the TrackSES platform.
2. Description of the service
TrackSES is a software-as-a-service platform that monitors email deliverability for Amazon SES (also referred to as AWS SES). The service includes a web dashboard, ingestion of SES event notifications via Amazon SNS, bounce, complaint, and deliverability metrics, alerts, and team features according to your plan. TrackSES connects to your AWS account with least-privilege, read-oriented access. We never request or obtain ses:Send* permissions on your AWS account and cannot send email on your behalf.
3. Account registration and security
You agree to provide accurate and complete information when you create your account and to keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. The AWS access keys you provide to connect your account are encrypted at rest. You must notify us promptly at support@trackses.com if you become aware of any unauthorized use of your account.
4. Subscriptions, pricing, and billing
Access to the service requires a paid subscription after any free trial. Prices are stated excluding value added tax (VAT); VAT is added where applicable according to the rules in force. Payments are processed by Stripe; we never store raw card numbers. Subscriptions renew automatically at the end of each billing period unless you cancel. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Your plan determines your limits, including the number of emails monitored per month and the event retention period. The plans currently offered, their prices, and their limits are set out on our pricing page.
5. Right of withdrawal and refunds
If you are a consumer in the European Union, you normally benefit from a 14-day right of withdrawal. For digital services that begin immediately at your request, this statutory right may be waived once performance has started with your prior consent. Regardless of this, we voluntarily offer a refund on request within 14 days of your initial subscription, within the stated conditions. To request a refund, contact us at support@trackses.com.
6. Acceptable use
You agree not to: process data relating to recipients who have not consented to receive your emails, where such consent is required; reverse engineer, decompile, or attempt to extract the source code of the service; resell or sublicense access to the service without our prior written permission; introduce malicious code or attempt unauthorized access to our systems or those of other users; or use the service in any way that violates applicable laws or regulations.
7. Availability
The service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free availability and provide no uptime commitment. We will communicate planned maintenance windows in advance when possible. We are not liable for losses resulting from service interruptions, except as required by applicable law.
8. Intellectual property and data ownership
TrackSES and all associated trademarks, logos, and content are owned by or licensed to 12N Labs. The email event data you send to TrackSES remains yours at all times. You grant us a limited, non-exclusive license to host and process that data solely to provide and improve the service to you.
9. Suspension and termination
We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or engage in activity that we reasonably believe may harm us or other users. You may request an export of your data before your account is closed. After account deletion, personal data is purged within 30 days, as described in our Privacy Policy.
10. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for any indirect or consequential damages, including loss of profits, data, or goodwill, arising from your use of the service. Our total aggregate liability for any claim shall not exceed the fees you paid for the service in the 12 months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
11. Data protection
When you send recipient personal data to us through SES events, you act as the data controller and we act as a data processor on your behalf, processing that data on your instructions to provide the service. The processing of personal data is governed by our Privacy Policy, available at /privacy.
12. Governing law and jurisdiction
These Terms are governed by French law. Any dispute relating to the service shall be brought before the competent courts of Paris, France. If you are a consumer, you retain the mandatory protections of the law of your country of residence and the right to bring proceedings before the competent courts of that country.
13. Changes to the Terms
We may update these Terms from time to time. We will notify you of material changes by email or through a notice on the platform. Your continued use of the service after such notice constitutes acceptance of the updated Terms.
